Abstract
The first rites to perform in Hajj rituals is entering into Ihram. The exalted prophet of Islam said “every Muslim is required to know Mighats to perform Hajj rituals and enter into Ihram there.” Failing to assume Ihram, no one can enter Allah’ sanctuary (Haram). Yet, if one fails to assume Ihram from designated Mighats for any reason, can he/she wear Ihram garb in Mighats’ adjacencies without going into the boundaries of Mighats or should he/she reach Mighat and assume Ihram there? Most Imamiye and general Islamic jurists consensually consider assuming Ihram in Mighats’ adjacencies the same as entering Ihram within the boundaries of Mighats. They consider Mighat per se not affecting the law. Considering the adjacency of Majid-ul Shajarah as a Mighat is quite incidental; however, those of other Mighats are subject to controversies and heated discussions and verdicts of Islamic jurists. Nevertheless, according to the Muslim traditions, it has not been necessary to enter Mighats. Knowing the law of assuming Ihram in the adjacencies of Mighats has caused difficulties for Islamic jurists and religiously responsible Muslim adults (Mukallafin) of any Islamic denomination background. The study the Islamic jurists’ comments and verdicts, limits of the Mighats’ adjacencies as well as serving the purpose of the study may only be done through adopting a descriptive library-based research approach towards jurisprudential propositions of Islamic denominations. Thus, the issue is inferred from narrations on adjacency rather than Masjid-ul Shajarah per se. what is stipulated in the narrations does not impose limitations and will be considered a prevailing trait in accordance with context cohesion presumption. And, there is reason to resort to the principles.
