This article adopts a descriptive-analytical approach to examine and analyze the human rights obligations of the host state, namely the Kingdom of Saudi Arabia, during the Hajj rituals. The central focus of this study is the manner in which Saudi Arabia engages with core principles of human rights in relation to foreign pilgrims, with emphasis on concepts such as human dignity, the right to life, security, freedom of religion, non-discrimination, and the right to peace. Given that Saudi Arabia is not a party to several key international instruments, such as the International Covenant on Civil and Political Rights (ICCPR), this paper relies on sources of international law including customary international law, peremptory norms (jus cogens), the United Nations Charter, and the jurisprudence of human rights bodies to argue that Saudi Arabia remains bound by international human rights standards despite its non-ratification. The paper analyzes specific instances of violations—such as the Mina tragedy, sectarian treatment of Shia pilgrims, racial discrimination against African pilgrims, and restrictions on religious practices not aligned with the state’s official interpretation of Islam—which reveal a pattern of violations of international human rights norms by Saudi authorities. مناسک حج به عنوان یکی از تجمعات بزرگ مذهبی جهان، بستری برای اعمال و رعایت حقوق بنیادین بشر به شمار می رود. این مقاله با روش توصیفی - تحلیلی به بررسی و تحلیل تعهدات حقوق بشری دولت عربستان سعودی در مناسک حج می پردازد. موضوع اصلی این پژوهش، نحوه تعامل دولت عربستان با اصول بنیادین حقوق بشر در قبال زائران خارجی با تمرکز بر مفاهیمی چون کرامت انسانی، حق حیات، امنیت، آزادی مذهب، منع تبعیض و حق بر صلح است.<br>با توجه به اینکه عربستان عضو بسیاری از معاهدات بین المللی، نظیر میثاق بین المللی حقوق مدنی و سیاسی نیست، مقاله با استناد به عرف عام بین المللی، قواعد آمره، منشور ملل متحد و رویه نهادهای حقوق بشری، سعی دارد اثبات کند که دولت عربستان به رغم عدم عضویت، همچنان به رعایت هنجارهای بین المللی حقوق بشر مکلف است. تحلیل مصادیق نقض این تعهدات در وقایعی چون فاجعه منا، برخوردهای فرقه ای با زائران شیعه، تبعیض نژادی علیه زائران آفریقایی و ممانعت از اجرای مناسک مذهبی غیر همسو با شریعت رسمی کشور میزبان، نشان دهنده نقض اصول حقوق بشر از طرف عربستان است که مخالف هنجارهای بین المللی است تا در نهایت مشخص شود که با توجه به عدم کارایی سازوکارهای داخلی عربستان و نبود نهاد بی طرف نظارتی در مراسم حج، راهکارهایی نظیر ایجاد منشور جهانی حقوق زائران دینی، فعال سازی نهادهای ویژه شورای حقوق بشر سازمان ملل و پیگیری حقوقی کشورهای متضرر از نقض حقوق زائران، پیشنهاد شده است. https://journal.hzrc.ac.ir/article_725522_64997ef613358a6d0fec4909a11c8927.pdf
