حوزه نمایندگی ولی‌فقیه در امور حج و زیارت پژوهشنامه حج و زیارت 2538-1768 2 1 2017 06 22 The Rule of “Simplification” and Its Role in Deducing Laws of Pilgrimage قاعده «تسهیل» و نقش آن در استنباط احکام حج 107 130 31078 FA رضا عندلیبی مدیر گروه فقه و حقوق پژوهشکده حج و زیارت Journal Article 2018 01 11 Pondering over the method of the holy legislator in enacting Islamic subsidiary laws in general and that of Hajj rituals and lesser pilgrimage in particular indicates that the lawmaker in Islamic law made the laws based on simplicity upon religiously accountable persons and the holy lawmaker has taken simplicity into consideration when enacting the laws. In other words, the holy lawmaker has made laws in a way that it will be simple for religiously accountable persons to implement them. Knowing the method of enacting the laws by the holy lawmaker, especially the laws of pilgrimage, is so important as it guides us towards the general rule in jurisprudence known as “rule of simplification”; the rule issuing decrees based on which is clearly seen in the books of the Jurists and their practical way of life in deducing religious laws. Accordingly, by citing this rule, a jurist is able to deduce a law for the religiously accountable persons in such a way that it will be simple for them to implement. Likewise, through this rule, he is able to issue his decrees particularly in the chapter on pilgrimage as alternative the decrees issued based on precaution that can be difficult for his followers in some cases. <span lang="FA" dir="RTL">تأمل در شیوه شارع مقدس در تشریع احکام شرعی فرعی به طور عام و در تشریع مناسک حج و عمره به طور خاص، حاکی از این است که امر قانونگذاری در شریعت اسلام، بر اساس سهل­گیری بر مکلفان است و شارع در تشریع احکام، سمحه بودن قوانین را مدنظر قرار داده است. به عبارت دیگر، شارع به دنبال جعل قوانین، آن‌ هم به گونه­ای است که مکلفان به سهولت از انجام آن برآیند. شناخت روش شارع در تشریع احکام شرعی، به‌ویژه در تقنین قوانین حج، از این جهت اهمیت دارد که می‌تواند ما را به قاعده‌ای کلی در فقه، به نام «قاعده تسهیل»، رهنمون باشد؛ قاعده‌ای که صدور فتوا بر اساس آن، به روشنی در آثار فقها دیده می‌شود و سیره عملی بسیاری از آنان در اجتهاد، بر آن استوار شده است. بر این اساس، فقیه می‌تواند با استناد به این قاعده در فرایند استنباط، حکمی را وظیفه فعلی مکلفان قرار دهد که انجامش برای آنان به آسانی ممکن باشد. همچنین صدور فتاوای مستند به این قاعده، به خصوص در باب حج، را جایگزین صدور فتوا بر احتیاط‌هایی نماید که ممکن است در برخی از موارد، موجب سختی و مشقت بر مقلدین گردد.</span> https://journal.hzrc.ac.ir/article_31078_41d877641441a7e1b49002de4cbf7ad3.pdf
