Despite its importance, religious tourism is less discussed and does not have a disciplined collection. Therefore, the statement of the problem and the necessity of doing this research can be considered in the analysis and induction of the rights of the elderly as pilgrims to <em>Baqī</em>, especially since the elderly sometimes form a large number of pilgrims to <em>Baqī</em>. In this article, aging is considered as a vulnerable situation in pilgrimage process, rather than being thought as a personal problem or a biological disorder, which requires the inclusion of special rights for the elderly and assigning tasks to the states dispatching pilgrims, the Saudi government, and pilgrims. This descriptive-analytical article concludes that the elderly have the right to pilgrimage based on arguments such as expediency and dignity, as well as the principles of equality and non-discrimination. Also, in this legal system, the right to health, positive discrimination, facilitating access, relaxation, and privacy are the issues that the host government of the elderly pilgrims (Saudi Arabia) should take care of. In addition, the governments that dispatch the elderly pilgrims should consider issues such as priority in allocating resources. گردشگری مذهبی، مبتنی بر مجموعه­ای از قواعد و انگاره­های حقوقی است که به رغم اهمیت، کمتر به بحث و گفت‌وگو واگذار شده و مجموعه­ای منضبط و احصاشده ندارد. از همین­رو مسئله و ضرورت این نوشته را می­توان در تحلیل و استقرای حقوق سالمندان به مثابه زائران بقیع دانست؛ بخصوص که گاه سالمندان، انبوه عظیمی از زائران بقیع را شکل می­دهند. در این نوشته، سالمندی، بیش از آنکه عارضه­ای شخصی و بیولوژیک قلمداد شود، وضعیتی آسیب­پذیر در فرآیند زیارت مطرح می­شود که نیازمند درج حقوقی ویژه نسبت به سالمندان و تکالیفی بر عهده دولت­های زائرفرست، دولت­ عربستان و زائران است. نوشته توصیفی-تحلیلی پیش ­رو، به این نتیجه دست می­یازد که سالمند، مبتنی بر ادله­ای چون مصلحت و کرامت و نیز اصل برابری و منع تبعیض، از حق زیارت برخوردار است. همچنین در این نظم حقوقی، حق سلامت، تبعیض مثبت، تسهیل در دسترسی، تخفیف و حریم خصوصی، انگاره­هایی است که باید مد نظر دولت میزبان زائر سالمند (عربستان)، و نیز مواردی چون اولویت در تخصیص منابع دولت‌های فرستنده مد نظر دولت فرستنده زائر سالمند قرار گیرد. https://journal.hzrc.ac.ir/article_244384_1013910b8a90b017ab03f1b65aef254c.pdf
