However, many non-Arabic pilgrims are unable to say talbīyah correctly, which causes their concern. Since different views are presented by the Imamiyyah jurists about the duty of these pilgrims, it seems absolutely necessary to understand jurists’ fatwas on this issue and examine their arguments to reach the truth. Different opinions of jurists are based on different narrations. Examining the authenticity of narrations and the validity of documents clarifies that the only flawless relevant narrations are two correct and authentic narrations, namely “masadah” and “zararah” which should be combined. The most traditional way of combining these two narrations is to combine their text and manifestation, which is also the most important innovation of this study. A “masadeh” narration clarifies the adequacy of the wrong saying of talbīyah by incapable pilgrims, and a “zararah” narration refers to the necessity of asking an agent to say talbīyah instead, which, according to the explicitness of the “masadah” narrations, we abandon this view and find it as a recommendation (istihab). Therefore, it is enough for incapable pilgrims to say talbīyah in any way they can; but they are advised to say talbīyah melodically (malḥūn), and at the same time, ask an agent to do it besides their own sayings, and it is more prudent to say the translation of talbīyah as well.}, keywords = {talbīyah,labbaik,incapable,melodically (malḥūn),agency}, title_fa = {بررسی فقهی وظیفه عاجز از تلفظ صحیح تلبیه}, abstract_fa = {یکی از واجبات احرام، تلبیه است که باید به‌صورت عربی و صحیح ادا شود؛ اما بسیاری از غیر عربزبانان از تلفظ صحیح تلبیه عاجزند و همین مسئله موجب اضطراب خاطر و نگرانی بسیاری از حجاج می‌شود و ازآنجاکه در مورد وظیفه این افراد، نظرات مختلفی توسط فقهای امامیه ارائه ‌شده است، شناخت فتاوای فقها در این مسئله و بررسی ادلة ایشان برای رسیدن به نظریة حق، کاملاً ضروری به نظر می‌رسد. نظرات متفاوت فقها برگرفته از روایات است، که پس از بررسی سندی و دلالی ادله، مشخص میشود تنها ادله بدون اشکال در این موضوع، دو روایت صحیحه «مسعده» و معتبره «زراره» است که باید بین آنها جمع کرد و عرفیترین وجه جمع بین این دو روایت، جمع به نص و ظاهر است که مهم‌ترین نوآوری تحقیق نیز به شمار می‌رود. به این بیان که روایت مسعده در کفایت تلفظ اشتباه توسط عاجز صراحت دارد و روایت زراره در وجوب نایب گرفتن برای تلفظ تلبیه ظهور دارد که ـ با توجه به ‌صراحت روایت مسعده ـ دست از این ظهور کشیده و آن را حمل بر استحباب میکنیم. بنابراین تلفظ تلبیه توسط افراد عاجز به هر نحوی که قادر به آن هستند، کافی است؛ اما احتیاط مستحب در این است که علاوه بر تلفظ ملحون، از استنابه نیز استفاده شود و احتیاط بیشتر در این است که ترجمه تلبیه نیز به آن افزوده شود.}, keywords_fa = {تلبیه,لبیک,عاجز,ملحون,نیابت}, url = {https://journal.hzrc.ac.ir/article_242773.html}, eprint = {https://journal.hzrc.ac.ir/article_242773_3301ce13aa5c5975a62e5212268bcacb.pdf} }
